X Social Media, LLC v. X Corp.
The plaintiff, X Social Media LLC, has filed a lawsuit against the defendant, X Corp., alleging violation of Sections 32 and 43(a) of the Lanham Act, unfair competition, trademark and service mark infringement, and violation of Florida's Deceptive and Unfair Trade Practices Act (FDUPTA). X Social Media is a Florida limited liability company that has used the X SocialMedia Mark in commerce since 2016. Defendant, X Corp., formerly Twitter Inc., is an online news and social networking site acquired by Elon Musk in 2022. X Corp. recently rebranded its platform as "X" and began using the "X" mark in connection with its social media services. X Social Media claims that this infringes on its X SocialMedia Mark and has caused confusion among consumers. The lawsuit seeks injunctive relief, damages, and attorney's fees. The parties are in the United States District Court for the Middle District of Florida.
