Bitterman V. Mobile Fidelity Sound Lab, Inc. Et Al
The lawsuit is a class action against Mobile Fidelity and Music Direct for falsely advertising their UD1S Products as all-analog recordings. However, it has been discovered that they incorporated direct stream digital (DSD) technology in their proprietary mastering chain. This misrepresentation has caused Plaintiff and other consumers to pay a premium price for these records, believing they were getting a pure analog recording. The lawsuit alleges that this misrepresentation was intentional and that the defendants profited from the increased value associated with purely analog records. Plaintiff is seeking compensatory damages, restitution, and equitable remedies for himself and members of the proposed class. The lawsuit alleges violations of the Magnuson-Moss Warranty Act and state consumer protection laws, as well as breach of express and implied warranties, fraud, and unjust enrichment.
